GENERAL TERMS AND CONDITIONS OF SALE
1. SCOPE OF APPLICATION
The present General Terms and Conditions of Sale (hereinafter "T&C") apply to all sales by:
- The Line official website theline.fr (hereinafter "The Line", the "Online Shop”, the "Website", or "We").
- Any individual (hereinafter the "Customer" or "You") that places an order on www.theline.fr (“The Line”).
The Line and the Customer (hereafter the "Parties") agree that their business relationship shall be governed exclusively by the T&C visible on the website at the time the order is placed. Goods and services related to the Online Shop, shall be governed exclusively by the T&C in the version applicable at the time the order is placed. All other terms and conditions of the Customer that may differ from those specified here shall not be recognized unless expressly agreed upon in writing. If any provision of these T&C be declared void or deemed unwritten, all other provisions will still apply. The Line delivers worldwide. The Line reserves the right to make changes to its Website www.theline.fr, and to the T&C. The fact that a Customer clicks on an link enabling the latter to read the T&C and place an order, implies his or her full, unconditional, irrevocable and definitive acceptance of all the provisions stated in the T&C.
2. CONCLUSION OF THE CONTRACT
The product descriptions in Our Online Shop do not constitute binding offers on the part of The Line, but merely serve the purpose of submitting a binding offer by the Customer. By placing an order, You submit a purchase offer contract that legally binds You. The contract shall be concluded when We accept the offer, by confirming or shipping the order. The automatic confirmation of an order serves the only purpose of informing You and does not imply any acceptance of the contract. The automatic purchase order registering system of The Line shall have a probative value in the absence of evidence of the contrary.
The prices indicated on Our Online Shop include all taxes, and exclude any of the shipping costs mentioned on the Website. The Line reserves the right at any time to modify its prices but will apply the prices that were displayed at the time of the order.
4. LIMITS OF LIABILITY
It is Your sole responsibility to verify that
- these products can be imported and used in the country of consumption
- You comply with the concerned tax and custom regulations.
5. PAYMENT OPTION AND DELAYED PAYMENT
You can pay for your order using the following payment option: credit card (CB, VISA, Eurocard, Mastercard). The Line enables You to perform 100% secured payment by using a fully secured transaction system via Payplug secured payment services (https://www.payplug.com). All data processed by Payplug are encrypted at the highest security levels. You can also pay via Paypal. Should payment be delayed, We reserve the right to charge interest of 10%.
Each order is valid to a single delivery address. You can have the ordered products delivered to another address than yours. In the event of partial shipping, we will bear any related additional shipping cost. All orders are processed and prepared for shipment between 18 days and 96 hours (public holidays and weekends), and dispatched in accordance with the terms of the delivery. The Line products are delivered by postal services. If your order comprises several products, it may be delivered in several separated packages.
Shipping cost: You are shown the shipping cost before the final checkout page.
The shipping time includes both packaging and transit times. In the event of any impediment for which The Line cannot be held responsible, the shipping time may be extended. Indications on delivery time are not guaranteed unless the deadline has been duly confirmed in writing under exceptional circumstances.
You must examine the order upon delivery to ensure that there are no visible signs of damaged, missing or incorrect package(s). In the event of damaged, missing or incorrect package(s), You must, without fail, contact The Line by email at firstname.lastname@example.org. You must always indicate your contact details and the purchase order number. All claims for lost or damaged products must be reported to us within 48 hours after receipt of the product(s). If this 48-hour deadline exceeds, or in the event of missing information, We will not be able to deal with the claim. The delivered product(s) that is/are claimed to be damaged or incorrect shall be returned in its/their original package(s) to The Line, at your expense. The Line's mailing address is available upon simple request.
7. GUARANTEE AND REFUND TERMS
The ordered & shipped products are only made to order. You shall without undue delay notify us in writing of any defect which appears, and return the concerned product(s) at the same time. To assert your right to a guarantee, you must report the defects immediately after receipt and after immediate inspection of the goods. The guarantee excludes defects resulting from improper handling by the carrier or you. You must return the concerned product(s) for refund at your expense within 48 hours (48h) after its/their receipt. The time period runs from the day when the order has been duly delivered. When the time period would end on a Saturday, Sunday, public or bank holiday, it would be extended until the end of the first following working day. Would you want to exchange the defective product(s) for the same item, the contribution to shipping costs will not be recharged. Return costs shall be borne by you. This right should be exerted as of the receipt of the product(s), which must be returned in its/their original package(s) and in the same condition as you received it/them, under any circumstances. When the time period would end on a Saturday, Sunday, public or bank holiday, it would be extended until the end of the first following working day. Once your return is received and inspected, we will notify you by phone, e-mail or mail of the approval or rejection of the request. Depending on the request and provided that The Line's conditions have been satisfied, then the concerned product(s) will be exchanged or a refund will be processed immediately. Shall the product(s) be returned, We would appreciate that you state your reasons in a joined mail so that we take the necessary measures to satisfy your requirements.
8. APPLICABLE LAW
The law in application is the one of the country where the offer was made. The business relationships resulting from the present General Terms & Conditions of Sale are subject to the French law. Any dispute relating to the conclusion, interpretation, execution or termination of a sale contract between the Parties, and more generally, in the event of any dispute arising from such sale, where both parties failed to reach an agreement, the competence shall be attributed exclusively to French courts.
